As a Company, we take your privacy seriously and are transparent about the data we collect about you, how we handle your data, and with whom it is shared. We have therefore created this privacy notice to make sure you understand how we collect and use your personal data in connection with your use of our services, whether through our web portal or mobile software application. This Privacy Notice applies to our talent recruitment and ancillary services offered through the Testamy platform (“Services”). It describes how and why we use personal data relating to: i. individuals who seek to access job opportunities via our platform (“Job Seekers”); ii.Employers’ representatives who provide job vacancies on the website in order to attract the right talents for these opportunities (“Employers”); iii.Visitors and all other users of the Testamy platform. We strongly encourage you to read this Privacy Notice to understand what personal data we collect, our lawful basis for processing your personal data, who we share your personal data with, and your rights in relation to your personal data. If you do not want us to process your personal data in accordance with this policy, we request that you DO NOT provide your data to us.

We provide recruitment services by collecting and analysing job requirements from employers and inviting job seekers to submit their resumes and other relevant work-related information. Our advanced AI algorithms evaluate candidates’ skills and experience, efficiently matching them with suitable job opportunities posted by employers.
Data We Collect
We may collect or receive the following information from Candidates or Hirers: - Name - Address - Telephone number - Email address - Date of birth - Location - Educational history - Job history - Job designations - National Identification Number - Photographs - Video footages - Next of kin - Referee information - Internet protocol address - Browser type - Date and time of accessing our website / Services - Website usage activities - Bank payment details - Other information that is accessible from your curriculum vitae.
How We Collect Personal Data?
We may obtain your personal data in the following ways: (a) Signing up: When you create an account with us, you would need to provide some personal data, including your name, email address, and contact number. We also collect certain personal data when you upload your Curriculum Vitae. (b) Communication: When you communicate with us through the chat function, online forms, email communication with our contact persons, and customer support, we collect your data, as well as any information you provide during the communication. This data enables us to respond to your messages. (c) Access to our Services: When you access and use our Services, we collect information about the access and use, the device, content, cookies, and usage data. (d) Social Media Data: We collect Social Media data when you choose to connect your social media account to your Testamy account. (e) Cookies on our websites: We use cookies (small files placed on your device) to improve your experience and the development of our Services. To this end, we may collect technical and statistical data from our websites, such as IP addresses, browser type and version, geographical location, and information about your activity in the Service. (f) Interviews carried out on our platform: We collect your footage when you agree to participate in automated job interviews as part of the recruitment process. (g) Automated Test Results: We collect information on your performance on online skills-based tests and other assessments conducted as part of our Services. (h) Background Check Service Providers: We may request the services of background check service providers to obtain information about your employment history, educational credentials, criminal history, national identification information, etc. (i) Your Referees: We may request your referees to provide information on their previous experience with you, including information on your work history and performance. (j) Bank payment details: We may collect some payment details to facilitate your payments for our Services. Where we obtain your personal data from third-party sources, we would advise you of the source when we first communicate with you in relation to the specific personal data.
How We Use Your Personal Data

Our Legal Basis for Processing your Personal Data
We are required by law to always have a lawful basis for processing personal data, and we would only process your personal data when we have a lawful basis to do so. For example, when you indicate your interest in a job role and provide your curriculum vitae and other relevant information, you consent to our processing your data to assess your suitability for the role and progress your participation in the recruitment process. We would request your consent before you are subject to our automated decision-making processes and profiling to assess your skills for specific job roles. We would also request your consent before you access automated job interviews and tests on our platform. You may withdraw your consent to our processing of your personal information for a particular purpose at any stage. If you decide to withdraw your consent, we will stop processing your personal data for that purpose unless there is another lawful basis that applies and we are relying on it, in which case we will let you know. (b) Performance of a Contract: We may process your personal data for the performance of a contract to which you are a party or, at your prompting, to take steps towards entering into a contract. For example, where we need to process your personal data as necessary steps towards securing a contract of employment between you and an Employer. (c) Legitimate Interest: Where it is necessary for our legitimate interest or those of a third party and your interests and fundamental rights do not override those interests. Here are some instances where we would process your personal data based on our legitimate interest, balanced with your fundamental rights: - Where we need to process your personal information to administer and document our agreement with the Company you represent - For invoicing for our Services and processing the transactions related to these invoices. - to process payment of our invoices provided or subscribed to by the Company. - To market our Services to you by contacting you by email or through other means. How Long Do We keep Personal Data?
We would generally retain your personal data as long as we need it to provide our services to you, or to comply with any legal obligation, or to protect our interests or the interests of others. If you choose to close your account, it would be deactivated immediately; however, it may take a few days for your account to be deleted from public views. Please note that we have no control over search engines that may still display your data in search engine results.
Anonymised Data
We may anonymise your data by converting them into statistical or aggregated form for research and analytics purposes. This way, you will not be identified or identifiable from the data, and your privacy will remain safe. The insights from our research and data analysis would help us understand and improve our Services. - Employers may receive personal data on persons who have applied to their job posts
Automated Decision-Making and Profiling
In the course of providing our Services, our AI system may automatically process your personal information, with limited or no human intervention, to evaluate certain aspects about you (known as profiling). This means that we may use computer software or predictive analysis to analyse your work experience, education, skills, online test performances, video interviews performances, etc., to make a decision on your suitability for specific job roles. You have a right to certain information about how we make these decisions and we would provide this upon request. You also have a right to ask for human intervention and challenge the automated decision.

We will not share your personal information unless we are entitled to do so. The categories of persons with whom we may share Candidate’s personal information include: - Employers who are interested in considering the Candidate for job vacancies - Background screening providers - Storage and technology services providers, including cloud solutions
Sensitive Personal Data
Sensitive personal data refers to personal information that is more private to you and are protected with stricter measures than applies to personal data. Sensitive personal data includes information on your ethnic origin, political opinion, genetic data, biometric data, health information, sexual orientation, etc. We do not want you to provide us with your sensitive personal data (whether through your curriculum vitae or other means) unless it is necessary or we specifically request it. To the extent that you provide us with any sensitive personal data, we would process that data only for any one of the following basis: - That you have explicitly consented to the processing of your personal data - That the personal data is needed to evaluate your suitability and capacity for specific job roles
Transfer of Data to Other Jurisdictions
While providing our Services, we may need to transfer data to countries or international organizations outside your country of domicile. This could involve sharing information with Employers or third-party service providers who support us. If the data is transferred, it may go to a country that has been deemed adequate by your country’s data protection regulator. If this is not the case, we make it a priority to identify any risks and, as much as possible, ensure appropriate safeguards are in place to protect your data in the foreign jurisdiction.
Your Rights in Relation to Your Personal Data
